1. Scope of Application
The following General Terms and Conditions apply exclusively to the business relationship between you and our company Thorpaket Luis Imandoost & Lee Hammond GbR, authorised managing partners Luis Imandoost and Lee Hammond, Haldesdorfer Str. 14, 22179 Hamburg.
We reserve the right to amend these Terms and Conditions at any time. Amendments will be published at www.thorpaket.de.
2. Definitions
- 2.1 Operator
- The Operator refers to the platform operated by Thorpaket Luis Imandoost & Lee Hammond GbR, through which customers can purchase digital Thortokens and have postal items delivered to partner shops.
- 2.2 Customer
- A customer is any natural person who purchases or redeems Thortokens in order to have postal items delivered to a partner shop and collect them there.
- 2.3 Thortoken
- Thortokens are digital codes that customers purchase via the Operator's platform and redeem to receive a Thorname and an associated QR code.
- 2.4 Partner shop
- A partner shop, also referred to in operations as a Thorshop, is an authorised location of an independent partner where postal items are delivered, stored, and handed over to customers. Partner shops are not postal service providers.
- 2.5 Postal item
- Postal items are all items addressed to a partner shop and dispatched by a shipping service provider. A distinction is made between letter items and parcel items.
- 2.6 Letter item
- A letter item is a postal item that, by reason of its format and composition, is suitable for delivery into a standard letterbox and can be transported via the regular letter post.
- 2.7 Parcel item
- A parcel item is any postal item that does not qualify as a letter item within the meaning of the preceding paragraph, in particular due to its size, weight, or shape.
- 2.8 Thorname
- A Thorname is a pseudonymous name generated by the Operator that the customer uses when addressing postal items. Each Thorname is uniquely linked to one QR code.
- 2.9 Collection period
- The collection period is the 28-calendar-day window within which a postal item must be collected, beginning on the day after the item is received at the partner shop.
- 2.10 Late fee
- A fee of €5.00 charged when a postal item is not collected within 14 calendar days.
- 2.11 Storage
- Storage refers to the temporary keeping of postal items at a partner shop until collection by the customer. No forwarding or onward dispatch of items takes place.
3. Formation of Contract
3.1 The Thortokens and services displayed on the Operator's platform do not constitute a legally binding offer but are a non-binding invitation to the customer to submit an offer to conclude a contract.
3.2 By completing the ordering process and clicking the "Buy now" button, the customer submits a binding offer to purchase Thortokens.
3.3 The contract for the purchase of Thortokens is concluded upon successful completion of the payment process. The Operator also confirms conclusion of the contract to the customer by email. The absence or non-receipt of the confirmation email does not affect the validity of the contract.
3.4 The contract for storage and collection services is only concluded upon redemption of a Thortoken and provision of a Thorname and QR code.
3.5 Before submitting an order, the customer has the opportunity to review, amend, or correct their entries.
3.6 The service is intended exclusively for adults. By concluding the contract, the customer confirms that they are at least 18 years of age.
4. Right of Withdrawal
Customers have a statutory right of withdrawal of 14 days when purchasing Thortokens. The right of withdrawal applies exclusively to Thortokens that have not yet been redeemed.
Upon redemption of a Thortoken and provision of a Thorname, performance of the service begins. During the redemption process, the customer expressly agrees that the Operator may begin performance of the service before the withdrawal period expires, and acknowledges that the right of withdrawal lapses upon provision of the Thorname.
After redemption of a Thortoken, withdrawal is excluded, regardless of whether a postal item has already been received.
5. Services
5.1 After redemption of a Thortoken, the Operator enables the customer to have postal items delivered to a partner shop of the customer's choice using a Thorname, and to collect them there.
5.2 For this purpose, the Operator provides the customer with an individual Thorname and an associated QR code, enabling the unique assignment of incoming postal items to the respective customer.
5.3 The partner shop receives postal items on behalf of the Operator, stores them for a limited period, and hands them over to the customer after successful verification of the QR code. Postal items are released exclusively after successful verification of the QR code. No additional verification of official identity documents takes place.
5.4 A postal item will be handed over to any person who can present the associated QR code. The QR code serves as the sole proof of entitlement. The customer is obliged to keep the QR code safe and to protect it from unauthorised access. In the event of loss or misuse of the QR code, there is no entitlement to release of the postal item.
5.5 The Operator and partner shops do not provide postal services within the meaning of the German Postal Act. Receipt of postal items is provided exclusively as a delivery address and final reception point after delivery by the respective shipping service provider. No forwarding, transportation, re-routing, or return of postal items takes place.
5.6 The Operator is not a contracting party of the respective shipping service provider. Responsibility for dispatch, delivery, and any delays, losses, or damage during transport lies solely with the respective shipping service provider.
5.7 The Operator's obligation is limited exclusively to providing the technical platform, organising storage at partner shops, and assigning postal items by means of Thorname and QR code.
6. Key Rights and Obligations
6.1 Information about postal items is provided solely to confirm whether an item is ready for collection. The customer may receive notifications in connection with collection and applicable collection periods, in particular reminders to collect, and notices that an item may only be collected for a further 14 days before a late fee becomes due under these T&Cs.
6.2 The address, including the Thorname, provided to the customer may only be used once. The address must be stated on the postal item completely, correctly, and in the following format:
First name: Name of the partner shop
Last name: Personal Thorname
Street of the partner shop
Postcode & city of the partner shop
If the address or Thorname is stated incompletely or incorrectly and the postal item cannot therefore be delivered or accepted, the Operator's entitlement to remuneration remains unaffected. The same applies if acceptance is refused due to breaches of these T&Cs.
6.3 Postage and all shipping costs are borne by the customer. They do not form part of the service provided by the Operator.
6.4 If a postal item cannot be accepted due to the partner shop's opening hours, absence, or other operational circumstances, the item will be handled exclusively by the respective shipping service provider. Any re-delivery or return to sender takes place under the shipping provider's own terms. The Operator accepts no liability in this regard.
6.5 If a parcel item is significantly and visibly damaged upon delivery attempt such that damage to the contents can be assumed, acceptance may be refused. This is intended to protect the customer's ability to assert claims against the shipping service provider.
In this case, the shipping service provider remains responsible for further handling of the parcel. As a gesture of goodwill, the customer will receive a new Thortoken for renewed use of the service; the original Thorname will be deactivated. There is no entitlement to a refund or any other reimbursement.
6.6 The Operator is entitled to exclude individual items from acceptance for legitimate reasons, in particular in the event of breaches of these T&Cs, safety concerns, or legal requirements.
7. Collection and Customer Obligations
7.1 The customer is required to collect their postal items no later than 28 calendar days after the day on which the item is accepted by the partner shop.
7.2 Collection within the first 14 calendar days is free of charge.
From the 15th calendar day onwards, a one-off late fee of €5.00 is charged for continued storage. This is payable at the partner shop upon collection.
Example:
Item received: Tuesday, 01.07.
Collection period starts: Wednesday, 02.07.
Last day of collection period: Tuesday, 15.07.
The day of receipt is not counted.
7.3 There is no entitlement to collection after expiry of the collection period referred to in paragraph 1.
7.4 If the customer does not collect a postal item within the collection period pursuant to paragraph 1, the provisions on handling uncollected postal items under section 8 of these T&Cs apply.
8. Handling of Uncollected Postal Items
8.1 If the customer does not collect a postal item within the 28-calendar-day collection period pursuant to section 7, the item will be treated as undeliverable.
8.2 Letter items not collected after expiry of the collection period will be returned, unopened, to the regular postal system. The customer has no entitlement to release or re-provision of the letter item.
8.3 Parcel items not collected after expiry of the collection period will be disposed of or destroyed by the Operator or by the partner shop on behalf of the Operator. No return to sender takes place.
8.4 Any exploitation, use, disclosure, or other commercial use of parcel items or their contents is excluded. Disposal or destruction takes place solely for the purpose of eliminating the parcel item.
8.5 The Operator is not obliged to inspect or document the contents of postal items prior to return to the postal system, disposal, or destruction.
8.6 Statutory obligations to retain, cooperate, or disclose to authorities remain unaffected.

Telephone support is not offered.
During the ordering process, the customer provides an email address. The Operator will use this address to send order confirmations, Thortokens, and other contract-relevant information.
Email is the authoritative channel for contract-relevant declarations and information. The Operator is entitled to choose the communication channel at its reasonable discretion.
The Operator endeavours to respond to enquiries promptly. There is no entitlement to a specific response time or round-the-clock availability.
10. Validity of Thortokens and Thornames
10.1 Thortokens are valid indefinitely and may be redeemed by the customer at any time.
10.2 A Thorname provided upon redemption of a Thortoken is valid for a period of 2 months for operational reasons. The validity period begins upon provision of the Thorname.
10.3 If a postal item is accepted by a partner shop during the validity period of the Thorname, the provisions on collection and collection periods under section 7 of these T&Cs apply from that point onwards.
10.4 If no postal item has been accepted during the validity period, the Operator may notify the customer by email before expiry of the validity period that the Thorname is about to expire and offer an option to extend. There is no entitlement to such a notification or to an extension.
10.5 If no extension is made before expiry of the validity period, the Thorname will be deactivated. Acceptance of postal items under this Thorname is no longer possible thereafter.
11. Excluded Postal Items
You agree to observe the following requirements:
11.1 Our services relate exclusively to postal items with a maximum length of 120 cm, a maximum girth (= length + circumference) of 300 cm, and a maximum weight of 31.5 kg.
11.2 In line with the terms and conditions of various postal service providers, the following postal items are excluded from acceptance, as they may not in principle be transported via postal services or are incompatible with the offered service for legal or operational reasons.
11.3 The Operator and partner shops are not obliged to inspect the contents of parcel items.
However, if there is a concrete suspicion of a risk to persons, property, or the environment — in particular due to leaking substances, unusual odours, sounds, or other external circumstances — the Operator or partner shop is entitled to take appropriate action. This may include opening the parcel to the extent necessary or referring the matter to the competent authorities.
12. Fees
12.1 Use of the service is subject to a fee. The amount depends on the number of Thortokens purchased:
1× Thortoken = €15.99
5× Thortoken = €63.99
20× Thortoken = €228.99
All prices are gross prices inclusive of all legally applicable taxes and charges.
12.2 Payment is made via the payment method chosen by the customer from the options offered by the Operator. Any fees charged by payment service providers or credit institutions are borne by the customer.
13. Liability
13.1 The address and Thorname provided to the customer must not be used as a billing address or stated to authorities, courts, or other third parties as a residential or business address. If such use occurs regardless, the customer is liable to the Operator for any resulting damages.
13.2 A provided Thorname is intended exclusively for the receipt of a single postal item.
If multiple postal items are nonetheless assigned to the same Thorname or a further item is in transit under the same Thorname, the customer may contact the Operator. In such cases, an additional Thorname may be provided for the extra item against payment of a handling fee of €3.99.
13.3 The customer is liable to the Operator for damages arising from a breach of contractual obligations, provided the customer is responsible for the breach. Liability does not apply where the customer proves they are not at fault. The customer shall indemnify the Operator against legitimate third-party claims to the extent they are based on a breach of duty by the customer for which the customer is responsible.
13.4 The Operator is unconditionally liable for damages arising from injury to life, body, or health caused by an intentional or negligent breach of duty by the Operator or its legal representatives or agents.
For other damages, the Operator is only liable for intent and gross negligence. Liability for simple negligence applies only in the event of a breach of a material contractual obligation (cardinal obligation), i.e. an obligation whose fulfilment makes proper performance of the contract possible in the first place and on whose observance the contracting party may regularly rely. In such cases, liability is limited to the typical, foreseeable damage. Liability under the German Product Liability Act remains unaffected.
13.5 The Operator accepts no responsibility for the contents of postal items. The contents of postal items are not inspected, unless a statutory obligation to do so exists.
13.6 The Operator bears no fault if the contents of a postal item fall within one of the exclusions listed in section 11, or if the item is seized, destroyed, or refused by the Operator as a result.
14. Confidentiality and Data Protection
14.1 The protection of personal data is a core concern of the Operator and an essential component of the service offered. The trust placed in us is valued and the greatest care is taken to protect personal data. Orders, data, and payment information are secured by appropriate technical security measures.
14.2 In connection with the purchase of Thortokens, the Operator processes exclusively the personal data provided by the customer during the ordering and redemption process, in particular the email address and — depending on the payment method chosen — billing-relevant data.
Upon redemption of a Thortoken, only a technical check of the Thortoken's validity is performed. No identity verification takes place. The creation of a Thorname is independent of the identity of the original purchaser.
Personal data are processed on the basis of Art. 6(1)(b) and (c) GDPR for the performance of the contract.
14.3 The Operator undertakes to treat all information obtained in the course of performing the contract in strict confidence and neither to disclose it to third parties nor to use it for other purposes.
This confidentiality obligation does not apply where disclosure:
- is required to fulfil statutory or official obligations,
- takes place on the basis of a judicial or official order, or
- is necessary to protect the Operator's own legal interests before competent authorities or courts.
In the event of disclosure, the customer will be informed without undue delay, to the extent legally permissible. The confidentiality obligation continues after termination of the contractual relationship.
15. Miscellaneous
15.1 German law applies to disputes arising from or in connection with a contract concluded on the basis of these General Terms and Conditions, to the extent that no mandatory statutory provisions preclude this.
15.2 Should any provision of these General Terms and Conditions be invalid, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by one that comes as close as possible to its commercial intent.
